General Rental Terms

1. Definitions

1.1 Lessor: Inez Kuiper, trading as The Factory House, part of Inez Interior Design, based in Muiden, the Netherlands.

1.2 Hirer: the natural person or legal entity that books the Location.

1.3 Location: The Factory House on the Krijgsman estate in Muiden, including the rooms and outdoor space that form part of the Booking.

1.4 Booking: the agreed hire of the Location for a specific date, duration and Use, as confirmed in writing by the Lessor.

1.5 Use: the purpose of the Booking, such as a photoshoot, film production, meeting, workshop or a combination of these.

2. Applicability

2.1 These terms apply to every Booking and every agreement between the Lessor and the Hirer concerning the hire of the Location.

2.2 Deviations apply only if expressly agreed in writing.

2.3 The Hirer's general (purchasing) terms and conditions are expressly rejected.

2.4 If any provision of these terms is void or voidable, the remaining provisions remain in full force.

3. Formation of the booking

3.1 A request via the booking form or by email is without obligation and does not count as a reservation.

3.2 The Booking is final as soon as the Lessor has confirmed it in writing and the deposit (article 5.2) has been received.

3.3 The Lessor may decline a request without giving reasons, for example if there is doubt about the intended Use of the Location.

4. Use of the location

4.1 The Location is used for the agreed Use, for the agreed duration and by no more than the agreed number of people.

4.2 Access is limited to the rooms that form part of the Booking, unless agreed otherwise.

4.3 The Factory House is also a lived-in home. The Hirer treats the interior and furnishings with care: no structural changes, no fixings (nails, screws, tape on surfaces) without prior consultation, and furniture is only moved after consultation and put back afterwards.

4.4 Smoking is not permitted inside the Location. Open fire, smoke or vapour effects only after prior consultation with the Lessor.

4.5 Pets are only permitted after consultation.

4.6 Given the location in a residential area, no amplified sound is used outdoors after 22:00, unless agreed otherwise in writing.

4.7 Exceeding the agreed end time is invoiced afterwards as extra hours, based on the agreed (half-day) rate.

5. Rates and payment

5.1 Rates are as stated in the quote or booking confirmation, excluding VAT.

5.2 On Booking, 50% of the agreed rate is invoiced as a deposit, payable within 7 days of the invoice date. The balance is invoiced no later than 7 days before the date of use and must be paid before the start.

5.3 For Bookings made within 14 days of the date of use, the full amount is invoiced at once.

5.4 Additional costs, for example extended hours, catering or styling support, are invoiced afterwards.

6. Security deposit

6.1 For photoshoots, film productions and gatherings of more than 10 people, the Lessor may ask for a security deposit. The amount is stated in the booking confirmation.

6.2 The security deposit is refunded no later than 14 days afterwards, less any costs for damage or extra cleaning.

7. Cancellation and changes

7.1 Cancellation by the Hirer is only possible in writing and results in the following costs:

  • More than 30 days before the date of use: 25% of the agreed rate.
  • Between 30 and 14 days before the date of use: 50% of the agreed rate.
  • Between 14 and 7 days before the date of use: 75% of the agreed rate.
  • Less than 7 days before the date of use, or no-show: 100% of the agreed rate.

7.2 Changing the date is free of charge up to 14 days before the original date of use, provided the new date is available. For later changes, the percentages of article 7.1 apply.

7.3 For cancellation by the Lessor due to force majeure or unforeseen personal circumstances, see article 11.

8. Liability and insurance

8.1 The Hirer is liable for damage to the Location, the contents and the garden that occurs during the hire period through the actions of the Hirer, their staff, guests or hired third parties.

8.2 The Hirer is responsible for insuring equipment and materials brought along. The Lessor is not liable for loss, theft or damage to the Hirer's property.

8.3 For productions with a larger crew or high-value equipment, the Hirer is advised to take out their own liability and/or production insurance.

8.4 The Lessor is not liable for indirect damage, consequential damage or lost revenue.

8.5 The Lessor's liability is in all cases limited to the amount of the Booking concerned.

9. Use of images

9.1 Images produced by the Hirer during the Booking may be used by the Hirer for the agreed purpose.

9.2 Unless agreed otherwise in writing, the Lessor may use a limited selection of atmosphere images of the Location itself, made during the Booking, for its own portfolio and promotion, crediting the brand or Hirer involved if desired and after mutual agreement.

9.3 Use of images produced by the Hirer for the Lessor's commercial purposes, other than as referred to in article 9.2, only takes place with the Hirer's express consent.

10. Access and practical matters

10.1 Arrival and departure times are as agreed in the Booking.

10.2 Parking on the property is free and limited to 3 spaces. Additional unpaid parking is available on the street. Extra transport for larger crews or groups by arrangement.

10.3 Wi-Fi, coffee and tea are included as stated for the agreed Use.

11. Force majeure

11.1 Neither party is obliged to perform in the event of force majeure, which in any case includes: exceptional weather conditions, fire, water damage, serious illness or death in the immediate circle of the Lessor, and government measures.

11.2 Because the Location is also the Lessor's home, the Lessor reserves the right to cancel a Booking in the event of unforeseen, serious personal circumstances. The Lessor reports this as early as possible and, where possible, proposes an alternative date. In the event of cancellation by the Lessor on this ground, the full deposit is refunded; the Lessor is not liable for other costs the Hirer has incurred as a result.

12. Termination

12.1 The Lessor is entitled to terminate the Booking with immediate effect in the event of a serious breach of these terms by the Hirer, including use of the Location for a purpose other than agreed or behaviour that endangers the Location or its surroundings. In that case, amounts already paid are not refunded.

13. Changes to these terms

13.1 The Lessor reserves the right to amend or supplement these terms. A Booking that has already been confirmed remains subject to the terms that applied at the time of confirmation.

14. Governing law and disputes

14.1 All Bookings are governed exclusively by Dutch law.

14.2 Disputes are submitted to the competent court in the district where the Lessor is established, unless the parties expressly choose another form of dispute resolution.
